General Terms

These Terms of Use govern your use and access of Usedo, including Usedo’s website, Usedo’s mobile applications, and any services provided by Usedo, (collectively called “Usedo”). Please read these Terms of Use carefully and in their entirety before your use of Usedo as these Terms of Use constitute a binding legal agreement between you and Microtechnologies Website Design & Operation Co. (“Microtechnologies”). Your use and access of Usedo represents your assent and acceptance of these Terms of Use. If you do not accept these Terms of Use, you may not use and access Usedo. Microtechnologies may amend these Terms of Use at any time of its choosing; the effective date of which shall be the date on which these amendments are posted on Usedo. Your continued use and access of Usedo following the posting of any amendments represents your assent and acceptance of the amendments. All users of Usedo shall be referred to as “User(s)” or “you” interchangeably throughout these Terms of Use. Users, for the purposes of these Terms of Use, shall include anyone, whether a natural or legal person, who uses, accesses, views, browses, registers, or submits material to, Usedo. These Terms of Use shall only govern the relationship between Buyers and Sellers to the extent expressed herein.

Intoduction

The following Terms and Conditions (henceforth, known as “Terms and Conditions”) set out the requirements to use Usedo’s application, website and other related services (henceforth, collectively known as “the Services”). The services include a technology platform that: allows users to upload listings of new or secondhand items for sale; allows users to browse a wide range of secondhand and new goods facilitates private and secure communication among users; facilitates the buying and selling of new and secondhand items by providing technology-based proprietary payment and shipping services; allows users to carry out safe and secure transactions that do not involve any form of direct contact and/or face to face interaction. By “the User” term, we mean those who have accepted these Terms and Conditions by using the website or the app after these terms and any update to it is published by Usedo. If you are not in agreement with any part of the Terms and Conditions, you should not use any of our Services. By accepting the Terms and Conditions the User agrees to: Read and understand the aforementioned and following terms; Accept all the obligations stated herein; Be over the age of 18 years old and have the adequate legal capacity to use the Services.

Changes

Usedo, the service provider reserves the right to modify, amend and update the Terms and Conditions at any time and without prior notice. Updates to terms and conditions will be communicated to users and continued use of the Services implies agreement to terms and conditions.

General

These Terms and Conditions apply to all users of the Services, including without limitation users who are sellers, buyers, and merchants. If you are entering into this agreement for and on behalf of a business entity, the term “you” in this agreement shall mean the business entity on whose behalf you are using the Services, unless the context does not permit. By using the Services in any manner, including but not limited to installing Usedo mobile applications, visiting Usedo website or utilizing the Services, you agree to observe and be bound by these Terms and Conditions, and policies referenced herein and/or those referenced to in Usedo’s User Guide.

Registration and Account Creation

In order to be eligible for using the Services, Usedo requires prior registration as a User, and acceptance of these Terms and Conditions. On becoming a User of Usedo, you willingly agree to the following: You are capable of entering into and committing to legally binding contractual agreements under applicable laws in your country of residence; You will provide true, accurate, up to date, complete and truthful information about yourself as prompted and stipulated by Usedo registration requirements; You will provide a valid mobile phone number and email address for registration and write your first and last name; Your name shall not include the word “Usedo” or any other words that may give users a false impression that you are associated with Usedo whether directly or indirectly; Your name shall not include any of your contact information including but not limited to your landline telephone number, mobile phone number and email address; You will provide your personal email address and a valid, actively in-use mobile phone number to be linked to your Usedo account when you first sign up for using the Services; If you are representing a business enterprise, organization or any other legal entity, you must have authority to bind the Entity to these Terms and Conditions accordingly; Your registration data shall be verified by Usedo through its standard registration data verification process. Without mobile number and email verification, you will not be able to access all the Services; As a seller, Usedo may require information such as your full legal name as it appears in your passport, date of birth, bank account information and/or credit card information in order to verify your identity and provide the Services to you; Depending on which services you choose to use, Usedo may require additional information for processing withdrawal requests and/or occasionally performing routine audits of transactions, including but not limited to bank account number, IBAN number, credit card holder’s name, credit card number, mobile phone number, and physical mailing address. In some cases, Usedo may require you to provide an electronically transmitted scanned copy of your ID documents such as passport, civil ID or resident card. You shall be solely responsible at all times for maintaining the security of your Usedo account since Usedo does not assume responsibility for any damage, misuse or loss of user accounts under any circumstances; You shall not set up multiple user accounts and/or transfer the ownership or sell your user account to any other parties.

Electronic Communications and Messages from Usedo

As a user of Usedo, you agree that we may communicate with you by email, mobile number, or through in-app messaging. Occasionally, Usedo will send you messages serving a variety of purposes. The default, required form of communication is in-app messages or emails. You will likely receive many messages from us throughout your use of the Services. Some messages from Usedo are service-related and may require action from you. Examples of service-related messages include, but are not limited to: a welcome/confirmation email when you register your account, an SMS verification code, a notification of offers and promo campaigns or correspondence with Usedo’s user support team. You may not opt-out of receiving service-related messages from Usedo, unless you request to permanently terminate your user account and to remove you from our users database. As a user, Usedo may also send you messages related to certain features on the mobile application related to your activity. Usedo may also send you news or updates about changes to our websites, mobile applications, or services, or terms and conditions.

Right to Refuse Service

Usedo reserves the right -at Usedo’s sole discretion- to cancel unverified or inactive accounts. Usedo reserves the right to refuse service to anyone, for any reason, at any given time.

Business Transfers

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, the registered user information may be part of the transferred assets.

Items That Cannot Be Listed for Sale on Usedo

Usedo prohibits the listing of all types of services as well as items that cannot be shipped. Consequently, Usedo prohibits the listing and sale of the following items. All kinds of services; Jobs and job-related posts; Personal ads and community events; Living animals and pets; Food, beverages spirit drinks and alcoholics; Medications, tablets and medical preparations; Flammables and flammable fireworks; Fake skincare products and cosmetics; Firearms and ammunition; Gold coins and nuggets; Cigarettes, e-cigarettes and other smoking equipment; Pornographic materials.

Listings Moderation

Usedo’s moderation team screens all listings prior to them appearing in the marketplace. This is to maintain a desirable product mix for the marketplace. Listings are approved or removed based on the following: Image policy; Description; Price accuracy; Prohibited listings; Duplicate items.

Image Policy

Buyers on Usedo base their purchase decisions on the images presented in a listing. Hence, photographs in the listing should be taken by the seller and must be of the actual item for sale. Generic photos of the same or similar products copied from a different website are prohibited. In addition, image clarity is important to ensure that all flaws and blemishes (if any) of the product are accurately represented. Images that are blurred or distorted will be removed.

Description

Sellers must include accurate and detailed description of the items they are selling on Usedo. Description must include valid and up-to-date details about the item to be offered for sale via Usedo such as state of the item (new, like new, fair, etc.) or details about its functionality. The description may not include a violation of Usedo system such as refusal to sell via Usedo shipping and payment system or a fraudulent request for cash transfers. Usedo team reserves the right to block such posts and the corresponding seller without prior notification at Usedo’s sole discretion

Price Accuracy

The price sellers enter at the time of listing their item should be the sale price at which the seller is willing to sell. Listing an item with a very low price only to cancel the order once a buyer purchases is grounds for account suspension. Usedo moderators will automatically remove listings that have unusually low prices. Listings for overly high prices will also be removed.

Duplicate Items

The Usedo moderation team automatically removes all items with duplicate titles. We encourage Usedo sellers to sell unique items. We discourage volume sales of the same items even with slight variations such as size or color. In order to give sellers equal chances, the moderation team will also block and prevent a seller -if the violation repeated- from adding any more listings.

Listings Removals

After initial moderation, a listing will show up on the Usedo home. We reserve the right to remove items that are deemed unsuitable at our sole discretion, even after initial approval. Users who have their items removed will not be informed about the decision to remove their listings prior to removal. However, if they feel that their listings have been removed in error, they may request a review by the user support team via in-app messaging or by email. Occasionally, the Usedo moderation team will block other types of listings that are flagged by our community as unsuitable (e.g. refurbished phones, fake products, deceptively described items and so forth).

A listing may be removed for one of the following reasons:

Contains nudity or inappropriate content Listing is for an item that is prohibited for sale on Usedo Offering animals or livestock for sale Images are copied from another user or website or are blurred and unrecognizable Reason to believe that the item is misrepresented Reason to believe that the item is not really for sale or unavailable Listings are repetitive and repeatedly posted in a very short amount of time

Listing price

The listed price of an item (as determined by the seller) composes of the following: Commission Shipping fees “Net profit” = amount the seller gets once the sale is complete Minimum listing price is 2 KWD Maximum listing price is 1000 KWD

Commissions

Commissions are paid by sellers as an administrative fee for Usedo facilitated services as follows: 12% commission on items price

Shipping Fees

Shipping fees are based on the size of the shipment and are the same across Kuwait. They are included in the listing price that is displayed.

Payment Options

There are two payment options available while purchasing items listed for sale on the Usedo: Existing Usedo balance consisting of earned & refunded amounts available in your Usedo wallet; Credit cards and K-Net; The Following rules applies to all payments within Usedo: Minimum payment amount is 2 KD Maximum amount per transaction is 1000 KD. Frequency: maximum Amount/User/Month is 5000 KD

Balance transfer

Once a sale is completed, the “Net profit” amount is credited to the seller’s account. The seller then has the option to transfer this amount to his bank account or keep it for future purchases. Once a transfer request is received, we process it within 48 business Hours. However, if inaccurate information is provided or other issues occur with third party transfer agents (banks, Paypal), transfers may take up to 5-7 business days. The following policies apply when processing transfers requests. Minimum amount for transfer request is 10 KD There is a maximum limit of 1000 KD/User/request. Frequency of transfer requests is: twice a month. Usedo does not deduct any fees on balance transfers, However if your bank or paypal cuts any fees, Usedo is not responsible.

Cancellations

Could be Requested by the buyer only before the order is accepted by the seller. Sellers have the option to cancel orders too before accepting them. Communication is key if a seller wants to cancel an order you should inform the buyer first through chat. Any user who has more than 3 cancellations in a 30-day period may have their account suspended without notice.

Refunds Policy

We guarantee that a buyer will receive the item he purchased or his payment will be refunded. We guarantee that a seller will get payment for the item he sold or he will get his item back. Refunds are processed within 5-7 business days after the reason for the refund is justified and approved. When shopping through Usedo, both sellers and buyers are protected by Usedo’s refund policy. This means that sellers will be guaranteed by Usedo to receive their sales and payments processed if they sell their items via our delivery services. Buyers are also equally protected by Usedo. Conditionally, buyers may request a full refund if they returned a return eligible item they had bought through Usedo’s system. Offline transactions between Usedo sellers and buyers are not protected under refund policy coverage. Thus, Usedo will not be liable to refund Neither buyers or sellers

Returns

A buyer may return an item if he initiates a return by sending a return request within 1 day of receiving the item. The buyer should choose the return reason and submit photos to validate the reason. A customer service agent will validate and contact the seller then will decide if the reason is valid or not. The buyer is required to respond to any communications regarding the return within 1 day or the return request will be canceled. When the return is done the seller will bear the shipping costs (2-ways) of the original transaction and the return transaction. Shipping costs will vary based on item size. Valid reasons for returns include: Item received is not the item that was purchased Item delivered is not as described in the listing or does not match the images of the item purchased Item has significant flaws that greatly affect usability and these flaws were NOT mentioned in the listing nor been mentioned in the chat. Invalid reasons for returns include: Buyer changed his mind Buyer doesn’t “like” the “color” or some other subjective characteristic of the item that doesn’t impact usability and function Item doesn’t fit even though the size indicated is accurate Item doesn’t function in a specific manner desired by the buyer, but that is not customary of the product (e.g. an Android phone that cannot download apps from Apple App Store. In the event that the reason for return is INVALID, the buyer will not be able to return the item. In the event of a dispute between buyer and seller, Usedo will arbitrate between the two parties based on the posted ad, in-app communications and photographic evidence provided by users. If either party does not provide requested evidence within 3 days, the dispute will be dropped in favor of the opposing party.

Lost Packages

In the event of lost packages, we are committed to protecting our users (both buyers and sellers) when such unintended mistakes happen. Accordingly, we are committed to either retrieving the correct package or refunding the user affected by the mistake for the actual value of the lost item. By actual value we mean the fair market value of the lost item (either new or used) after reaching agreement with the buyer or the seller. This will be settled between the affected party and Usedo’s user support team. You can only reclaim a lost package within one week after you are notified that the package has been delivered. Regardless of our response time, we will take into account the first time you sent us an inquiry with the specific order ID of the lost item.

Pick-Up (When a User Sells an Item)

For any courier pickup for a newly placed order, we will make 3 attempts to pick up the item. After the third attempt, we reserve the right to cancel the order without notifying the seller and refund the buyer. In cases of multiple failed order pickups caused by a single seller for no valid reason, we reserve the right to either suspend or permanently terminate the seller’s user account at our sole discretion and without prior notification.

Delivery (When a User Buys an Item)

You are obligated to check the item you received from our courier and ensure it is in the same condition mentioned in the listing, then click on “Confirm delivery”. By this confirmation you are confirming that the item you received is exactly as shown on the listing.

Community Guidelines for Interaction

Usedo is both a marketplace and a community. Members are encouraged to connect and communicate in public and private spaces through the mobile application. Here are some guidelines to keep in mind: Please use your best judgment when posting in these spaces or communicating with others on Usedo. Be aware that any personal information you share there can be read, collected, or used by others, or could be used to send you unsolicited messages. Usedo will remove any ad listings with overt personal or contact information such as email and phone numbers. However, if you share your personal information via private chat that will be on your own responsibility and may lead to account suspension. Another Usedo member may follow you to receive updates about your public profile activity such as new listings and posted reviews. You have the option to report & block members if you do not wish to share your updates with that specific person at your own discretion. Usedo offers a built-in instant messaging platform that allows buyers and sellers to communicate privately within Usedo’s mobile application. You have the option to block a user you are chatting with. Once blocked, the user will no longer be able to send you private instant in-app messages regarding the present item or any other item in the future. You may unblock any blocked user through in-app chat. In the case of experiencing any technical issues, please consult with the Usedo user support team who will help you report your technical problem and fix the issue.

Fraud Prevention and Accounts Suspension

Usedo marketplace and Usedo employees reserve the right to flag, cancel and investigate every single transaction that took place on Usedo including checking the identity of both seller and buyer on both ends and their contact and payment information as well. If either user were found to break Usedo’s Terms and Conditions, one or both accounts will be suspended either temporarily or permanently. For all fraud-related inquiries concerning payment or transfer requests please email security@usedoapp.com for further claims. Usedo may, at its sole discretion, block users who consistently violate the image policy or sell prohibited items. Usedo may also suspend accounts of high-volume sellers in case of repeated violations. A user account may be temporarily suspended or permanently terminated at the sole discretion of the Usedo team for activity that contravenes Usedo Terms and Conditions or perceived as inappropriate or fraudulent, including but not limited to prohibited transfer of balances between accounts, buying and selling among linked accounts, credit card fraud, general abuse of refund, returns and cancellations policies and harassing other users. * All credit card fraud cases are reported to local authorities without prior notice, all relevant account information including names, emails, mobile numbers, and addresses will be shared with local authorities

Account Suspensions and Terminations

This section is about account termination whereby termination is a unilateral decision made by Usedo’s team to suspend a user’s account indefinitely. As enablers of peer-to-peer commerce, Usedo is responsible for creating and maintaining a community of trust among buyers, sellers and the company and its employees. Usedo may suspend or terminate a user’s account for any of the reasons cited below: Violations of the terms of use and policies as stated in this Terms of Use. More than three order cancellations from the same user account without sufficient, reasonable and valid justification. More than three returns to the same seller by dissatisfied buyers who provide justifications that indicate the seller's fault. More than three complaints received by Usedo about the same user account reported by other users. Reported harassment** by any other member of the Usedo user community, Usedo employees or partners. All of the preceding rules in place are set by the Usedo to protect the community from fraud and to ensure good relations among users. All these rules apply to Usedo marketplace, and other complimentary services. Fake users** all user accounts who failed to verify by email correspondence and phone calls.

License

Usedo grants you a limited, non-exclusive, non-transferable, non-commercial, and revocable license to: (1) view, access and use Usedo on your personal device for the Site Services; and (2) access and use any and all viewable content and information for your personal use. You may only use the Site Services for your own personal use. You shall not use any automated, robotic or artificially intelligent means to extract any data from Usedo. Your access and use of the Site Services shall not violate any proprietary rights held in the Site Services or the viewable content and information by either Usedo or other third parties. You may not alter, modify, change, delete or destroy any content and information viewed on Usedo. Any rights not expressly granted under this License are reserved by Usedo.

User Content

Any content posted, uploaded, or submitted, or by any other form, by you on Usedo shall grant Usedo, and any other entity designated by Usedo, a non-exclusive, worldwide, unlimited, irrevocable, sublicensable, and transferable right to exercise any rights you have in the content, currently or in the future, including copyright and trademark rights, in any type or form of media currently known or in the future, and to make, use, reproduce, or any other form of use, the User Content. You grant Usedo the right to advertise its Site Services based on your use of Usedo and via the use of the User Content. Usedo has the unilateral right to remove any of your User Content at any time and for any reason. You represent and warrant that: (1) your User Content is either owned or licensed to you; and (2) your User Content does not violate the privacy, publicity, and contract rights, or any other legal rights, of any person or entity. Except as otherwise indicated in the Privacy Policy, you agree that your User Content shall not be subject to any confidentiality or proprietary rights or restrictions. Your relationship with Usedo is not a legally special relationship, except with respect to these Terms of Use. Usedo is under no obligation to enforce any intellectual rights you may have in your User Content, nor shall Usedo monitor your, or any other User’s, User Content before such posting. You shall be responsible and liable for your User Content. Your User Content must not include any defamatory, hateful, libelous, violent, obscene, pornographic, or otherwise offensive content.

Disclaimer

Usedo Services are provided “as is” and “as available”. Usedo disclaims all representations and warranties which are not expressly indicated in these Terms of Use, whether express, implied or statutory, including the implied warranty of merchantability, implied warranty of fitness for a particular purpose. Usedo further makes no representation with respect to the timeliness, reliability, quality, or availability of Usedo Services, or any other services or goods provided by Usedo, or that Usedo Services shall be error-free or uninterrupted. The risk of using Usedo Services shall, to the maximum extent permitted under applicable law, remain with you.

Limitation of Liability

Usedo shall not be liable for any indirect, incidental, special, punitive or consequential damages including lost profit, lost data, personal injury, or property damage, related to or as a result of your use of Usedo Services. Usedo shall not be liable for any damages arising out of your reliance on Usedo Services, or in connection to losses due to your transactions with third-parties in reliance on Usedo Services.

Indemnity

You indemnify and hold harmless Usedo, its affiliates, directors, and employees from any and all claims, demands, losses, liabilities, and expenses, including attorneys’ fees, arising out of or in connection to your use of Usedo Services, your breach of these Terms of Use, your User Content, or your breach of the rights of any third-parties.

Applicable Law and Designated Forum

These Terms of Use shall be construed and governed by Kuwaiti law only. In the event of a dispute, User shall seek to amicably resolve the dispute with Usedo by contacting Usedo. If the dispute is not resolved amicably, Kuwaiti courts shall be the exclusive and sole venue and forum for any litigation relating to these Terms.

Notice

Usedo may provide notice to You via your Account email. You are deemed to have received notice after 12 hours of your receipt of the email. You may serve notice on Usedo by mailing such notice to Usedo’s listed address.

Assignments

You may not assign these Terms of Use to any third-party without Usedo’s written permission. Usedo may assign these Terms of Use without your permission to any of its affiliates, subsidiaries, successors by merger or acquirers of Usedo equity. If a court of law of adequate jurisdiction renders void a term of these Terms of Use, the rest of these Terms of Use shall not be affected.

Language

These Terms of Use are presented in both Arabic and English. These Terms of Use shall be construed in its Arabic version, as the English version is only presented for clarification purposes.

Privacy Policy

This Privacy Policy is the policy upon which Usedo shall process, disseminate, distribute, destroy, or use certain types of personal information provided by Users of Usedo throughout their use of Usedo. All users of Usedo shall be referred to as “User(s)” or “you” interchangeably throughout this Privacy Policy. Users, for the purposes of this Privacy Policy, shall include anyone, whether a natural or legal person, who uses, accesses, views, browses, registers, or submits material to, Usedo.

Password

You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify Usedo of any unauthorized use of your password or any breach of security. You also agree that Usedo cannot and will not be liable for any loss or damage arising from your failure to keep your password secure. You agree to not provide your username and password information in combination to any other party other than Usedo without Usedo’s expressed written permission.

Account Information

You must keep your account information (e.g., location, user ID, verification number) up-to-date and accurate at all times, including a valid email address and mobile number.

Account Transfer

You may not transfer or sell your Usedo account and User ID to another party or sell any services related to the use of Usedo mobile application such as automated likes , follows or user reviews.

Data Collection Policies

Usedo uses the personal data users provide in a manner that is consistent with our Privacy and Protection of User Data policies detailed in this Terms of Use. For instance, if you contact us by email or other messaging means, we will use the personal data you provide to answer your question or resolve your problem, or if you confirm a transaction using Usedo, we will use the financial data you provide to complete the transaction. Usedo may also use your personal data and other personally non-identifiable information collected through our services (‘likes’ on the app, category of items posted) to help us customize our services, improve the content and functionality of our services, better understand our users, and prevent fraud. Usedo may use this information to communicate with you regarding our existing services and features or to tell you about services we believe will be of interest to you. If we do so, any marketing communication we send you, will contain instructions permitting you to “opt-out” of receiving future marketing communications. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us.

Cookies and Tracking Technologies

Usedo uses a variety of technologies to help us better understand how people use our application and services. Usedo uses cookies for a number of purposes, including but not limited to accessing your information when you sign in; keeping track of preferences you specify; displaying the most appropriate content based on your interests and activity on Usedo; estimating and reporting Usedo’s total audience size and traffic and conducting research to improve our content and services. Usedo may partner with third-party service providers who may use various tracking technologies, such as browser cookies or flash cookies, to provide certain services or features. These technologies allow a partner to recognize your mobile device or computer each time you visit Usedo, but do not allow access to personally identifiable information from Usedo. Usedo does not have access or control over these third-party technologies, and they are not covered by our privacy statement.
